EMB MANDATE

The EMB is a Line Bureau By Virtue Of Section 34 Of The Philippine Clean Air Act Of 1999 (Ra 8749).  The Bureau Is Mandated To Implement On A Nationwide Scale The Six (6) Important Environmental Laws To Wit:

Under E.O. 192, EMB is mandated to provide research and laboratory services; and serve as secretariat in the adjudication of pollution cases.

Under EO 320, EMB is designated as the secretariat of the Designated National Authority for CDM of the Kyoto Protocol to the United Nations Framework Convention on Climate Change


EMB FUNCTIONS

Under Presidential Decree Number 984, Pollution Control Law of the Philippines

  • Conduct original plant surveys/inspection
  • Conduct investigation/inspection on complaints relative to pollution and conduct source sampling test, ambient air sampling, and evaluates sampling results to determine existence and extent of pollution;
  • Conduct the technical conference/public hearing to discuss matter for the resolution of the case;
  • Conduct follow-up inspection to check compliance of commitments during the technical conference and to check the efficiency of the firm’s Wastewater Treatment Plant (WTP) and Air Pollution Control Devices prior to the issuance of permit Operate;
  • Issue a Temporary Permit to Operate of the firm’s Wastewater Treatment Plant (WTP) and Air pollution source and Control Installations (APSCI) and Solid Waste Disposal Systems (SWDS);
  • Gather prima-facie evidences against pollutersand files pollution cases in the pollution Adjudication Board;
  • Evaluate and review the applications for Authority to Construct & Permit to Operate;
  • Recommends for issuance of Authority to Construct (AC) and Regular Permit to Operate (PO) both for the WTP, APSCI and SWDS; Notice for Violation;
  • Assist in the implementation of the Cease and Desist Order (CDO), Temporary/Formal Lifting Order (T/FLO), and other Resolution issued by PAB;
  • Conduct ambient air and water quality monitoring and collects samples for laboratory analysis;
  • Conduct survey and monthly collection of water samples and recommend the river/water bodies for classification;
  • Perform physical, chemical, and bacteriological analyses both for air, water, and wastewater samples submitted by the by the technical personnel including the field offices specialists, and samples from private sectors as requested;
  • Evaluate the applications for Accreditation of the Pollution Control Officer and recommend the issuance or denial of the Certificate of Accreditation;
  • Assist the Local Government Unit in accomplishing the ecolabeling form for submission to the Special Concerns Office for devaluation;
  • Assist/support the Local Government on the Implementation of Anti-Smoke Belching Campaign.
